In February 2007 the hands free legislation was updated and a penalty point system introduced. An important part of the updated legislation often misunderstood is that merely interacting with a hand held mobile device whilst driving (i.e. pressing a button or canceling a call) is illegal, it is not just the act of speaking. This is particularly important because most modern phones, Blackberry’s and PDA’s include features like Sat Nav which are useful features to drivers.
Another important aspect of the revised legislation is the responsibility of employers to ensure their drivers are safe and legal. The revised legislation includes a duty of care provision placing the responsibility on the employer to not cause or permit a driver to use a hand held phone whilst driving.
